Claims Support
Preparation, review and defence of construction claims for delay, disruption, acceleration and change, in close partnership with counsel.

Claims built on evidence, and defences built the same way.
A construction claim has to do four things at once: establish entitlement under the contract, prove causation, quantify the effect in time and money, and survive a sceptical reader, possibly a tribunal. Most claims that fail do so on causation or on a quantum that cannot be traced to cost records.
For contractors and subcontractors we build claims from the ground up: an entitlement narrative linked to the record, a delay and disruption analysis using named methods, and a quantum that reconciles to job cost. For owners we review incoming claims with the same discipline, identifying global or total-cost approaches, double counting and unsupported productivity loss.
Where productivity is in issue, we prefer a measured mile comparison of impacted and unimpacted periods where the records allow, and we explain clearly when they do not. We work closely with counsel and, where appropriate, under their instruction to preserve privilege.

What leaders ask us first.
Straight answers from the people who do the work. If your question is not here, ask us directly. A senior practitioner will reply.
Will you work with our lawyers?
Yes. We work closely with counsel throughout and, where appropriate, under their direct instruction so that our work product benefits from privilege. Early involvement lets the analysis and the legal strategy shape each other.
Can you quantify disruption as well as delay?
Yes. Where records allow, we use a measured mile comparing productivity in impacted and unimpacted periods of similar work. Where they do not, we explain the alternatives, such as earned value or industry studies, and the weight a tribunal is likely to give them.
Why do total-cost claims tend to fail?
Because they assume every dollar of overrun was caused by the other party and that the original estimate was sound. Tribunals rarely accept those assumptions without proof. We build quantum from cause-and-effect links instead, which is harder work and far more persuasive.
Should we prepare a claim while the project is underway?
Ideally entitlement is documented as events occur. Contemporaneous claims are better evidenced, less adversarial and far more often settled before close-out.
