In short

Secure the time that is due, and resist the time that is not.

An extension of time decides whether a contractor is relieved of liability for late completion and whether an owner can recover liquidated damages. The contract usually sets strict rules for notice, timing and substantiation, and in many forms a missed notice can bar entitlement altogether. The commercial stakes are rarely matched by the attention paid to the paperwork.

We work from the contract outward. For contractors we map the notice and substantiation requirements, keep notices timely and build the delay analysis that proves cause and effect. For owners and contract administrators we assess EOT applications fairly and rigorously, so time is granted where it is due and the liquidated damages position is preserved where it is not.

Time and money are separate questions. We keep the extension of time distinct from any claim for prolongation cost, which normally needs its own entitlement under the contract, and we prepare each on its own evidence.

Questions, answered

What leaders ask us first.

Straight answers from the people who do the work. If your question is not here, ask us directly. A senior practitioner will reply.

What happens if a contractual notice was missed?

It depends on the wording of the contract and the governing law. Some clauses are strict conditions precedent; others are not, and doctrines such as waiver or prevention may apply. We review the position with your counsel immediately, because the answer shapes everything that follows.

Which contract forms do you work under?

AIA, ConsensusDocs, FIDIC, NEC, government standard forms and bespoke contracts. We work alongside the client’s legal advisers on interpretation.

Does an extension of time include costs?

Not automatically. An EOT relieves the contractor of liability for delay damages. Recovery of prolongation cost usually requires a separate entitlement, typically tied to an employer risk event, and its own quantum. Under the SCL Protocol, concurrent contractor delay can defeat the cost claim without defeating the time.

Can you act for the owner as an independent assessor?

Yes. Owners and contract administrators appoint us to assess applications, recommend determinations and record the reasoning, which protects the decision if it is later challenged.
